These Terms of Use (“Terms”) govern your use of the Volthero power bank rental services (“Services”) provided by Volthero LLC (“Volthero”, “we”, “us”, or “our”). These services allow you, the user (“User”, “you”), to rent power banks for charging electronic devices while at participating businesses, providing a platform for advertising. By using our Services, you agree to be bound by these Terms, so please read them carefully.

Acceptance of Terms
By using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.

Use of the Services

• Eligibility: You must be at least 18 years old and located in New Jersey, New York City, or Miami to use our Services.

• Rental Process: Follow the instructions provided on our website to rent a Volthero power bank. You are responsible for returning the power bank in good working condition after the end of the lease.

Fees and Payments

• Rental Fees: The fees for renting the power banks will be disclosed at the time mentioned in the contract. All fees are due the same day mentioned in the contract.

• Late Returns: Late returns may incur additional charges, as specified in the contract.

User Responsibilities

• Care of Power Banks: Handle the power bank carefully and return it in the same condition as it was dispatched. You will be responsible for any damage or loss while it is in your possession.

• Compliance with Laws: Use the power bank in compliance with all applicable laws and regulations.

Prohibited Uses
You are prohibited from:

• Modifying, disassembling, or tampering with the power banks.

• Posting illegal content or any content in the power banks without authorization, depending on the plan you have selected.

• Using the power banks for any unlawful purpose.

Intellectual Property
All intellectual property rights in the power banks and any related materials provided by Volthero are owned by or licensed to us. You may not use such materials without our prior written consent.

Warranty and Limitation of Liability

• General Warranty: We provide a general warranty for the power banks, which covers defects in material and workmanship under normal use. This warranty does not cover damages caused by misuse or abuse of the equipment.

• Limitation of Liability: Volthero will not be liable for indirect, incidental, special, or consequential damages resulting from your use of the Services, including but not limited to errors in content, delays in shipping or service visits, website downtime, and issues related to third-party links, to the extent permitted by law.

Termination
We may terminate your access to the Services without notice if you violate these Terms.

Dispute Resolution
Disputes under these Terms will be handled according to the jurisdiction of the contracting LLC as follows:

• For Volthero LLC, New Jersey: In the event of a dispute, we first encourage direct communication to reach a mutual agreement. If resolution cannot be achieved, disputes will be resolved through arbitration in the State of New Jersey, in accordance with the laws of New Jersey.

• For Volthero LLC, New York City: In the event of a dispute, we first encourage direct communication to reach a mutual agreement. If resolution cannot be achieved, disputes will be resolved through arbitration in the State of New York, in accordance with the laws of New York.

• For Volthero LLC, Miami: In the event of a dispute, we first encourage direct communication to reach a mutual agreement. If resolution cannot be achieved, disputes will be resolved through arbitration in the State of Florida, in accordance with the laws of Florida.

Each party will be responsible for their own arbitration costs unless the arbitrator determines that your claims are frivolous, in which case, you may be ordered to reimburse us for certain costs and fees.

Changes to Terms
Volthero reserves the right to modify these Terms at any time. You are advised to review these Terms periodically for any changes.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
