Important! Please carefully read these Terms of Use ("Terms"), as they affect your legal rights and obligations.
You agree to these Terms by accessing or using any of the Volthero Platforms, including the direct or indirect use of a Volthero power bank, chargers, or associated Volthero product. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS, DO NOT USE A VOLTHERO PLATFORM.
These Terms apply to the Volthero websites that post these Terms, Volthero power bank and Volthero chargers, each of which is owned or controlled by Volthero LLC ("Volthero," "we" or "us"), and any available interactive features, applications, widgets or other outlets including Volthero partner stations that post or include a link to these Terms (collectively, "Volthero Platforms") or facilitate all of the Volthero products.
Modifications
Volthero reserves the right to modify or add to these Terms at any time without prior notice. Your continued use of the Volthero Platforms after we post Updated Terms constitutes your agreement to those Updated Terms.
Rental Terms
A Volthero Rental begins at the time of rental and becomes due the following day. All rentals are for a 30-day minimum. Your credit card will be charged $150 for the first month, then $100/month automatically.
If you fail to return your rental or damage it, you will be charged an overdue fee of $200, minus rental fees already paid. A temporary hold of $15 is placed at the start. You have up to 3 minutes to return a checked-out power bank free of charge if you decide against renting it.
Power banks can also be purchased directly for $99.99. Purchased chargers not reported as faulty or returned within 24 hours are non-refundable.
Ownership of Materials
All materials on the Volthero Platforms (graphics, layout, text, images, designs, logos, trade names, etc.) are owned or licensed by Volthero and protected by copyright, trademark, and other laws. Materials may not be copied, reproduced, or distributed without express permission.
Your License to Use Materials
You may not use the Materials to suggest association with our brand, modify them, reverse-engineer any code, use bots or scrapers to extract content, or redistribute Materials without written consent.
Copyrights and Intellectual Property
Volthero follows DMCA notice-and-takedown procedures. Copyright infringement claims should be sent to info@volthero.com with the required DMCA information (signature, identification of the work, contact info, good-faith statement).
Registration
Providing registration information is optional but required for some features. You must provide accurate information and are responsible for maintaining confidentiality of your account and password.
Sales
All sales are final and non-returnable except as required by law.
Widgets & Applications
Any embeddable widgets we provide remain our exclusive property; you may not modify, sell, or misuse them, and we may disable them at any time.
Third-Party Links
We are not responsible for third-party sites linked from our Platforms. Linking to our site requires that you not imply endorsement, misrepresent us, or use our trademarks without permission.
Your Warranties
You represent that you have the legal right and capacity to enter these Terms and are authorized to use your payment method.
Disclaimer of Warranties
The Volthero Platforms and products are provided "AS IS" and "AS AVAILABLE" with no warranties of any kind, to the fullest extent permitted by law.
Limitation of Liability
Volthero is not liable for any indirect, incidental, or consequential damages related to use of the Platforms or products. Total liability will not exceed the amount charged for the transaction. Your exclusive remedy for a defective rental or purchase is a substitute of equal or lesser value.
Indemnification
You agree to indemnify Volthero against claims arising from your use of the Platforms, breach of these Terms, or violation of applicable laws.
Term and Termination
Volthero may terminate your access at any time without notice if you violate these Terms. You may terminate a rental by returning the product or completing the maximum rental period with payment.
Location and Territorial Restrictions
The Volthero Platforms are intended for use in the United States. Users accessing from elsewhere are responsible for compliance with local laws.
Governing Law; Disputes
These Terms are governed by the laws of the State of Florida. Legal proceedings must be brought in the state or federal courts located in Miami, Florida.
Miscellaneous
Failure to enforce any provision does not waive Volthero's rights. If any provision is unenforceable, the rest remains valid. Volthero is not liable for delays caused by events beyond its reasonable control (force majeure).
